These Terms & Conditions ("Terms") govern your access to and use of the Spendy mobile application and related services (collectively, the "Service"), operated by Spendy ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By completing onboarding, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated here by reference.
2. Description of the Service
Spendy is a personal budgeting and expense tracking application. It helps you build a spending plan, allocate money to budget categories ("give every dollar a job"), log income and expenses, view statistics and a calendar of your money, and set savings goals and challenges. All financial information in Spendy is entered manually by you; the Service does not connect to bank accounts or financial institutions.
Any summaries, statistics, projections, reminders, or suggestions shown in the Service (including estimated dates by which you may "feel the difference") are generated automatically from the information you enter and are intended as general budgeting guidance only. They are not financial, investment, tax, legal, or debt advice, and are not a substitute for advice from a qualified professional. We do not guarantee the accuracy, completeness, or usefulness of any calculation or insight, and you are solely responsible for the accuracy of the information you enter and for any financial decisions you make.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian.
4. Your Data and Device
Spendy does not require an account. Your budget, transactions and settings are stored on your device, and you are responsible for maintaining the security of that device, keeping it backed up, and for any activity that occurs through it. We are not responsible for loss of data resulting from device loss, failure, deletion of the app, or backup settings you control.
5. User Content
"User Content" means the names, budget categories, transactions, notes, goals, and any other information you enter into the Service. You retain ownership of your User Content.
To the extent any User Content is transmitted to or processed by us or our service providers (for example, if you contact support), you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and use that content solely for the purpose of operating and providing the Service to you. You represent that you have all rights necessary to submit your User Content and that doing so does not violate the rights of any third party, including any other member of your household whose information you enter.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to reverse engineer, decompile, disrupt, overload, or gain unauthorised access to the Service or its underlying systems;
- Circumvent, or attempt to circumvent, any subscription, licensing, or purchase-verification mechanism;
- Use the Service to build a competing product, or to scrape or harvest data from it;
- Enter information about other people that you do not have the right to use.
7. Subscriptions & Payments
Certain features of the Service ("Spendy Premium") require a paid subscription, offered on a monthly or yearly basis. Prices are shown in the app before you purchase and may vary by region. Purchases are made through the Apple App Store; payment is charged to your Apple ID account at confirmation of purchase and is subject to Apple's terms.
Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings; cancellation takes effect at the end of the current billing period, and you will retain access to premium features until then. Any free trial or introductory offer, if available, converts to a paid subscription unless cancelled before the trial ends. You can restore previous purchases using "Restore purchases" in the app. Except where required by law or by Apple's refund policies, payments are non-refundable; refund requests must be directed to Apple.
8. Intellectual Property
The Service, including its software, design, illustrations, branding, and content (excluding your User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the Service on Apple-branded devices you own or control for your own personal, non-commercial purposes, in accordance with these Terms and the App Store's usage rules.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any calculation, statistic, projection, or reminder will be accurate or lead to any particular financial outcome. You use the Service, and act on any information it provides, at your own risk. Always verify important figures independently and consult a qualified professional before making significant financial decisions.
10. Limitation of Liability
To the maximum extent permitted by law, Spendy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, savings, or goodwill, or any financial loss arising from decisions made in reliance on the Service, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $50.
11. Apple-Specific Terms
These Terms are between you and Spendy only, not with Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for it. To the extent any warranty applies and is not disclaimed, Apple's sole warranty obligation is to refund the purchase price to you, if applicable. Apple is not responsible for addressing any claims relating to the Service, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time by deleting the app; this does not automatically cancel any active subscription, which you must cancel through your App Store settings. Provisions that by their nature should survive termination will survive.
13. Changes to the Service or These Terms
We may modify, add, or remove features of the Service, and we may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes may be communicated through the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
